7月31日、米国国土安全保障省(DHS)はウイグル強制労働防止法（UFLPA）Entity Listに新たに43社を追加すると発表しました。この発表は8月3日（月）より施行され、UFLPAによる制裁対象企業数が大幅に増加しました。DHSのプレスリリースによると、この拡大によりリスト掲載組織数は30％増となり、「史上最大規模のリスト拡大」となりました。
今回の動きは、その背景にある状況から特に注目されています。7月31日の発表以前、トランプ政権はUFLPAおよび関連法規や制裁に対し、特別な関心を示していませんでした。最後に企業がUFLPA Entity Listへ追加されたのは2025年1月15日で、これはトランプ大統領とその政権が就任する約1週間前のことです。一部の企業や業界関係者は、UFLPAのもと制裁を受ける144社が当面の間は変動しないだろうと考え、危機意識が薄れていた可能性もあります。
DHSによる最新の措置により、状況は一変しました。UFLPAは、米国企業に対し、サプライチェーン内で強制労働を利用している中国企業を特定し排除する新たな責任を課しています。
UFLPAが積極的に執行されている法律である点は強調に値します。米国税関・国境警備局（CBP）の担当官は、高度なソフトウェアを用いて申告内容を審査し、制裁対象企業や、新疆ウイグル自治区（XUAR）から出荷された製品との関連を調べています。該当の貨物や製品は、CBPによって留置や押収の対象となります。実際、DHSはUFLPA施行（2022年）以来の留置件数などの統計を公表しています。これまでに数十億ドル規模の製品がUFLPAのもと国境で押収ないし留置されています。
2025年にトランプ大統領が就任して以降、一時的に留置件数は大幅に減少しましたが、今回のUFLPA Entity List拡大が施行強化の前触れとなる可能性があります。米国企業は自社の輸入品がCBPによる厳格な審査を受ける覚悟が必要です。
7月末、米国国土安全保障省はUFLPAのもと新たに43社の中国企業に対し制裁を課すと発表しました。これら企業は鉱業、金属生産、電子部品製造、バイオ医薬など多岐にわたる業種に属しています。
